Important Changes to Employment Authorization Document Processing and Validity Times

September 22, 2023

On September 20, 2023 the Biden administration announced that beginning October 1, 2023 USCIS will:

  • Accelerate processing for Employment Authorization Documents (EADs) filed by parolees who scheduled an appointment through CBP One.
  • Aim to decrease the median processing time for EADs from 90 days to 30 days for EADs based on CBP One parole, as well as for EADs based on Cuban, Haitian, Nicaraguan, and Venezuelan parole.
  • Increase the maximum validity period of initial and renewal EADs to 5 years for certain noncitizens, including those admitted as refugees or granted asylum, recipients of withholding of removal, and applicants for asylum, adjustment of status, or cancellation of removal. The longer validity dates will apply to initial or renewal EADs issued after the announcement.

These measures are intended to clear EAD processing backlogs and decrease EAD processing times in all categories.  If you have any questions regarding your EAD card, please contact your LTF representative.
